Hi there and welcome to the legal bit, this is here to protect both you and us at all times where required. Please rest assured however that Branx Fitness will always endeavour to resolve any dispute to the satisfaction of all parties involved, we have built our company on treating our customers with great respect and integrity and will always do everything in our human power to ensure our customers are happy not only with there purchase but the service received from us.

This site is owned and operated by BRANX FITNESS LTD hereinafter referred to as ‘Branx Fitness’. Registered number 06756845 (UK). Whilst every effort has been made to ensure that the information contained on our website is accurate and up to date, Branx Fitness Ltd cannot be held liable for any errors, omissions or price changes. This is due to continuous product development specifications; possible colour changes and we may also substitute a product for one of similar or better quality. PRODUCT SUITABILITY

Please note that all products on the main Branx Fitness website are designed for home use and carry a home use warranty only, unless stated otherwise. Equipment purchased from our website and used in a non domestic environment will render the warranty null and void unless the equipment description states it is suitable for commercial use.

HOW TO ORDER

We have a few methods for you to place your order - telephone, email, online and mail. All orders must be paid for in full before they will be shipped. This includes any item that is put on back order for you because it is out of stock. Payment is necessary so that we can allocate the incoming stock to your order. If you do not wish for payment to be taken for back order items, we will be able to leave the item on back order for you, but we cannot guarantee that there will be free stock available to fulfil your order.

Please note: in all cases we must have a contact telephone number for you. We will not be able to process your order without this information.

We accept the following payment cards: VISA and Mastercard credit cards and Debit cards with a VISA or Mastercard logo. We also accept Paypal (online only). Bank Transfer.

Phone & Online Orders - If you are ordering by credit / debit card / Paypal / Bank Transfer the goods must be sent to the cardholder’s registered address. If you require the goods to be sent elsewhere (i.e. a work address) you must telephone or email Branx Fitness prior to ordering. You will be required to provide additional information. Please note: we are unable to accept orders under £10 (excluding delivery).

Mail Orders - If ordering by post you must provide all relevant information (i.e. product code and description, name and address, postcode and contact telephone numbers) Please allow 5 working days for clearance of personal cheques on top of normal delivery time.

WARRANTIES

All equipment sold by Branx Fitness is brand new (unless otherwise stated) and is covered by a minimum of 1 year for parts and labour warranty cover for home fitness use only. The warranty includes a full on site repair facility or a 'back to base warranty’. In some cases, where there is a minor fault, we will send a part by mail for the customer to fit (the delivery cost is payable by the customer). (This warranty excludes consumable parts and damage caused by accident, or misuse and also excludes any cosmetic damage, wear or tear)

Branx Fitness Ltd warrants their products to be free from defects in workmanship and material, under normal use and service conditions.

-Treadmills - 2 Year parts and labour, 5 years motor.

-Elliptical Cross Trainers, Bikes, Rowing Machines, Steppers & Strength - 2 Years parts and labour (unless otherwise stated)

  • The warranty is only valid when the equipment is used in a private domestic environment.
  • The warranty guarantees the product to be free from defects in workmanship and material under normal use and service conditions
  • This warranty does not cover 1, normal wear and tear, 2, any adaptations or changes to upgrade the product from its normal purpose 3, damage resulting from; transportation; abuse or misuse; non private domestic use; repairs not provided by a Branx Fitness Ltd authorised service provider; accidents, lightening, water or fire; improper environment including but not limited to humid, dusty or external. (examples: garages, cellars).

Your statutory rights remain unaffected by the consumer guarantee.

This warranty will be granted only on production of a satisfactory proof of purchase.

In the unlikely event of a problem occurring on your Branx Fitness machine, you should contact our customer service team on email: [email protected] or call us on: 01763 802124. Stating the equipment you have, (brand and model number), serial number and a brief description of the fault along with your name, address, postcode and phone number. The main thing to always include is your order ID number and date of purchase.

Branx Fitness will either arrange to send a part for the customer to safely fit, send an engineer to site, or in some instances, ask that the goods be returned to our warehouse. Goods must be well packaged prior to collection. No goods will be accepted into our warehouse without prior authorisation from Branx Fitness. Branx Fitness will then repair or replace the equipment with an equivalent or better model and deliver the goods back to the customer at our expense. On some products, the labour element of warranties might only be applicable to mainland UK. If in doubt, please ask for details.

WARRANTY INFO EXPLAINED

FRAME

Branx Fitness warrants the frame against defects in workmanship and materials for a period from the date of original purchase, so long as the device remains in the possession of the original owner. Warranties are none-transferable.

ELECTRONICS & PARTS

Branx Fitness warrants the electronic components and all original parts for a period from the date of original purchase, so long as the device remains in the possession of the original owner.

LABOUR


Branx Fitness shall cover the labour cost for the repair of the device for a period from the date of the original purchase, so long as the device remains in the possession of the original owner and has not been miss used.

EXCLUSIONS AND LIMITATIONS



This warranty applies only to the original owner and is not transferable. This warranty is expressly limited to the repair of replacement of a defective frame, electronic component, or defective part and is the sole remedy of the warranty. The warranty does not cover normal wear and tear, improper assembly or maintenance, or installation of parts or accessories not originally intended or compatible with the fitness equipment as sold. The warranty does not apply to damage or failure due to accident, abuse, corrosion, discoloration of paint or plastic, or neglect. Branx Fitness shall not be responsible for incidental or consequential damages. All returns must be pre-authorized by Branx Fitness. Branx Fitness&requo; obligation under this warranty is limited to replacing or repairing, at Branx Fitness&requo; option, the product at one of its authorized service centres. A Branx Fitness authorized service centre must receive all products for which a warranty claim is made. These products must be received with all freight and other transportation charges prepaid, accompanied by sufficient proof of purchase. Parts and electronic components reconditioned to As New Condition by Branx Fitness or its vendors may sometimes be supplied as warranty replacement parts and constitute fulfilment of warranty terms.

All prices quoted are correct at time of going to press, due to circumstances beyond our control these may change, including rate of Value Added Tax. The price levied will be confirmed at the time of ordering.

We strive to keep the majority of the products listed on our website in stock at all times. Occasionally some items are out of stock. If you order an item that is out of stock, we will contact you within 48 hours (2 working days) and advise you when the item is due back in or of any comparable product that is available.

Refunds will be made within 14 days of our receipt of goods. All refunds must be authorised by our staff.

DATA PROTECTION

All customer information will be treated under the terms of the Data Protection Act. We will not pass on your details to other companies. We may identify and inform you of other products and services offered by Branx Fitness, which would be of interest to you. You must tell us if you do not wish us to do so.

We do not store credit card details nor do we share customer details with any 3rd parties.

COMPLAINTS

Branx Fitness takes all of our customers seriously and we try to offer them the best possible service available, however if you feel you have something to complain about please contact us.

RETURNS / CANCELLATIONS

YOUR STATUTORY RIGHT TO CANCEL

Under Consumer Contracts (Information, Cancellation and Additional Charges) Regulations, you have the right to cancel most products purchased from us using distance means and receive a full refund within 14 days of delivery. We must be notified of your intention to cancel in writing or email and the cost to return the goods will be the responsibility of the customer. Please note any items that are clearly personalised or made specifically to the consumer’s specifications are exempt from these regulations. We also reserve the right to make a deduction from refunding the full purchase price if we believe (on examination of the returned goods) that they exhibit use (including self assembly and attempts at disassembly). The amount of deduction will be based on the extent of the diminishment in the goods value.

Under the terms of the aforementioned Regulations you have the right to cancel any service (purchased using distance means) we offer and seek a full refund within 14 days beginning the day after the contract is concluded.

However by you agreeing that we commence carrying out this service before this cancellation period has expired, Branx Fitness wish to inform you (the consumer) in writing that you will not be able to cancel this contract of service under the regulations once the performance of the installation service has been completed.

We will ask you to sign a form to this effect immediately prior to installation. Please note this does not negate your rights to have any incomplete or faulty workmanship corrected by us. Consequently you will not be eligible for any refund in relation to any specific charges we have made for the installation of these goods.

FURTHER GOODS CANCELLATION POLICY

All order cancellations or returns must be notified to us by e-mail only. If you wish to cancel or return goods please e-mail our customer service department at the address below and we will issue a Return Materials Authorisation (RMA). Goods must be returned to us within 14 days of receipt of RMA.

If you order stock that is regarded as a special/one off order, you cannot return for refund. These items are non-returnable and are not covered by distance selling rights. Any goods damaged will have to be returned via suppliers return pouch.

The cost of postage, packaging and insurance to return the goods will be borne by the customer and goods must be received by us in perfect condition and in their original packaging. The cost of delivering the goods will be deducted from any refund. There may be a re-stocking charge. If goods are not received back in perfect condition and in their original packaging, Branx Fitness reserves the right not to accept the goods at our warehouse and/or not to issue a refund or credit. Any costs to redeliver the goods will be payable in advance by the customer. If the goods have been removed from their original packaging or assembled, your option to cancel may be forfeited.

Please note: our couriers do not collect any unpackaged goods.

Our Standard 30 day online return options apply to goods purchased for domestic use only. These options do not apply to equipment purchased for use by a business, commercial equipment, or for any ‘special order’ items.

Special order items are goods that are not normally stocked by Branx Fitness and have had to be ordered specifically for a customer. These options also do not apply to any Nutritional Supplements, software, DVDs, videos or books where the security or outer seals have been broken.

Mail Order Returns/Ex. Display Models are classed as ‘one off’ ‘special order’ items, and as such are not covered by our standard 30-day online return option

Any free gifts received with your order must be returned if an order is cancelled.

WEEE (WASTE ELECTRICAL AND ELECTRONIC EQUIPMENT) Regulations

Each EU Member State now has a legal obligation to minimise the disposal of WEEE in landfill sites. The broad aim of the WEEE regulations is to address the environmental impacts of electrical and electronic equipment when it reaches the end of its life.

We all have a responsibility to contribute to the reuse, recycling and other forms of recovery of WEEE under these Regulations. Over 75% of waste electrical goods end up in landfill, where lead and other toxins contained in the electrical goods can cause soil and water contamination which can lead to negative effects on human health and the environment.
Electrical and Electronic Equipment that was made after 13 August 2005 should display the crossed-out wheelie bin symbol on the packaging or product. The purpose of the symbol is to encourage householders to dispose of their WEEE separately from household waste.

What can you do?

Reuse: If your old machine is still working, do you know somebody who would like to use it?

There are many organisations such as schools, clubs, residential homes etc., who would be very happy to have the use of your old equipment. In addition, there are organisations that will reuse and repair electrical and electronic equipment and some even run "cash for recycling" schemes.

Recycle: If your old equipment is no longer useful, please recycle it.

Benefits of recycling

Recycling unwanted electrical products is better for the environment. Lead and other toxins contained in electrical goods can cause soil and water contamination. This can have a very harmful effect on the natural habitat, wildlife and also human health. When situated near populated areas these toxins can cause problems to communities as their water and soil is polluted.

Many of the electrical items that we throw away can be repaired or recycled. Recycling products helps save natural resources and also reduces the environmental and health risks associated with sending waste electrical goods to landfill.

Please note: Where applicable, your old machine must be dismantled prior to collection as our engineers are not permitted to do so. Find more information on WEEE recycling and locate your local recycling centre at www.recyclenow.com.

Reviews

When can you write a product review?

You can write a product review when you have purchased the product being reviewed from Branx Fitness.

What should you write about?

Your review must reflect your own first-hand Experience. You are required to concentrate on relevant points about the product. It is acceptable to evaluate the purchased product's functionality and quality.

If your review contains non product related information, you may be asked to modify your review or it may be removed. The review must not include any of the following:

  • Opinions on other products/brands.
  • Defamatory statements or a violation of the Branx Fitness Guidelines.
  • Violent/coarse language or a sexist/racial character.
  • Any personal information about another individual, including another person's name, address, phone number, electronic mail address, credit card information or any other information that could be used to track, identify, contact or impersonate that person. You accept and agree that Branx Fitness may remove any of the above violations from the review. You also accept and agree that Branx Fitness may remove references to other companies and websites (including links) from the review. Removed information is replaced with blank spaces or similar, and Branx Fitness will not otherwise make alterations to your review.

When do Branx Fitness remove your review?

As a main rule, Branx Fitness do not remove reviews from their website. However, some reviews are in violation of the Branx Fitness Guidelines and/or applicable law, and in these cases Branx Fitness retain the right to remove your review. Below are some examples of when Branx Fitness may remove your review:

  • Your review violates Branx Fitness’ Guidelines or Terms & Conditions.
  • Branx Fitness asks you to modify your review, and you do not do so within the deadline mentioned in Branx Fitness’ email to you.
  • Your review is of a marketing nature or has marketing purposes.
  • You are a competitor of Branx Fitness Ltd.
  • You have created multiple profiles to review Branx Fitness Ltd several times.
  • Branx Fitness have asked you to forward proof of your Buying Experience with Branx Fitness and no or insufficient documentation has been provided within the deadline.

For the avoidance of doubt, Branx Fitness do not remove a review if:

  • Your review and the number of awarded stars are seemingly conflicting, e.g. if you awarded a product only one star but wrote a very positive review the reviewed product.
  • Branx Fitness thinks your review is "unfair", e.g. because your dissatisfaction is a result of a mistake made by the supplier.

Please note: you must be able to send proof of your Buying Experience up to 12 months from the date that you wrote your review.

Third-party app functionality

Third-party apps integrations on Branx Fitnes equipment may be subject to change, and is under the control of the product manufacturer and/or network provider who sometimes chooses to opt out of certain functions or features. Branx Fitness is not at fault if manufacturers and/or network providers choose to change the apps and integrations on their equipment.

SECURITY

We take your security very seriously at Branx Fitness. That's why any transactions you make over our website are instantly encrypted and completely safe, and all your credit card details are securely passed to our provider for approval, so we not only do not see your credit card details, they're also not stored in any of our databases.

CONDITIONS OF FREE DELIVERY

At present, free delivery is offered to all Branx Fitness customers on selected domestic equipment transactions on all Mainland UK orders (England, Wales and Scotland). There may be a delivery surcharge on orders to Northern Ireland, Scottish Highlands or Islands including but not limited to Isle of Wight, Isle of Man, Channel Islands, Isle of Lewis, and Orkney. The below list of postcode areas all come with surcharges. Please note these charges are not put on by Branx Fitness but by the carriers. Please call or email the sales office for further details.

Customers will be informed of any delivery charge before we fully process your order unless it has already been provided to you. All items, where applicable will be delivered in boxes for home assembly by the customer. Goods will normally be delivered within 5-10 working days. Our free delivery service will deliver your goods Mon-Friday between 8am and 6pm. Our carriers will always endeavour to call you prior to delivery to arrange a mutually convenient time for delivery but can not give a specific delivery time.

For a small surcharge, deliveries can be chosen for an AM or PM delivery or a Saturday morning. Please contact us for further details. As a general rule, all orders over £99 in value will be delivered free in UK mainland, with surcharges to Northern Ireland, Scottish Highlands or Islands including but not limited to isle of Wight, Isle of Man, Channel Islands, Isle of Lewis and Orkney. Please see above postcode list of some of the most popular areas that carry a surcharge.

To check simply proceed to shopping basket and check your available delivery options. Please note sometimes our online systems might not pick up on your postcode instantly if you are based in a surcharge able area, but Branx Fitness Ltd will always inform you of any costs before processing your order fully.

Depending on the delivery company and their individual health and safety policy, this may mean your goods are delivered to kerb side. Our free delivery does not include the driver taking your purchase upstairs internally or externally. Drivers are not insured to enter your property. On all heavy items like treadmills we operate a 2 man delivery service but at times they may only use 1 man, which will mean the driver may require assistance from you to assist or move the goods from the drop off point into your home.

Please do not ask the delivery driver to lift heavy items without sufficient manpower, as this will often be in breach of Health & Safety legislation.

Free delivery, where provided, applies to the UK mainland only. Free delivery is provided only to customers purchasing equipment for home use; not for commercial installations.

Scottish Highlands, Northern Ireland and all UK Islands may incur an additional charge and take longer. This includes but is not limited to postcodes beginning AB30, AB31, AB33. AB34, AB35, AB44, AB45, AB51,AB52, AB53 and AB54 and the above postcode list.

Branx Fitness use both internal and third-party carriers. Occasionally deliveries can be delayed for reasons out with our human control. Branx Fitness cannot be held responsible for losses relating to late or failed deliveries.

INSTALLATIONS

All installation prices quoted on our website are for ground floor installations within 100 miles from our Royston Head Office (postcode SG8 7PU). If your installation address is further than this, we will contact you prior to processing payment if the charge is more than the figure stated. If you require further information, please contact us on 01763 802124 or email [email protected] for a cost prior to ordering. We regret we are unable to accommodate installations to offshore postcodes.

We will always try to arrive on time, but we will not be held responsible for late arrival due to unforeseen circumstances.

It is imperative that the space for the product(s) has been cleared and that access is unrestricted. If the installer is unable to commence work due to the area not being cleared or access not being available at the agreed time, Branx Fitness reserves the right to charge £25 for every half hour the installation engineer is unable to start work. We must be informed at the time of placing the order where the product(s) are to be installed. All prices quoted are for ground floor installations in the main building of the property. Installations above or below ground floor or outside the main building (i.e. in an outhouse, etc.), may be subject to surcharge, especially if not mentioned at the time of order.

Branx Fitness are within their rights to refuse any installation if the installer deems the installation location or access point to be hazardous, or the request unreasonable. If the product does not fit into the area where the installation is requested and a representative of Branx Fitness did not measure the area, then Branx Fitness cannot be held responsible. Therefore, the customer will incur the cost of the visit. Agreed installation times must be adhered to.

Adequate parking/vehicle access must be provided by the customer. Any charges incurred by the installer for parking will be chargeable. If the installation time is extended due to inadequate parking/access then the extra time will also be chargeable at £50 per hour.

DISCLAIMER

Branx Fitness endeavour to keep product information as up to date as possible. However, specifications are liable to change without notice. Product photographs are intended to illustrate the particular model but may, occasionally, not reflect the product as sold. Unless specifically stated, weights, bars and other accessories shown on photographs are not included -please call for further details on any particular product. Whilst every effort is made to provide accurate and up to date information, Branx Fitness cannot be held responsible for any errors or omission on our website or brochures.

All orders made by you through the Website are subject to acceptance by us. We may choose not to accept your order for any reason and will not be liable to you or to anyone else in those circumstances.

After submitting an order to us we will send you an order acknowledgement email with your order number and details of the goods that you have ordered. Please note this email is an acknowledgement and is not an acceptance of your order.

For certain goods, information concerning stock availability is not available on the Website. If you order goods, which are not available from stock, we will contact you by e-mail and you will have the option to wait until the goods are available from stock, or cancel your order in accordance with our cancellation and returns policy. In the event your order is cancelled, we will refund any payment already collected from you in respect of that order, in accordance with our cancellation and returns policy.

Any email or other electronic acknowledgement by us of receipt of an order placed by you does not constitute legal acceptance by us of your order.
